WHAT ARE THE DOB INSPECTION REQUIREMENTS FOR BOILERS?
*Note: As a result of Local 126 of 2021 the DOB has made adjustments to deadline timeframes*
The DOB requires all boilers to have an annual inspection by December 31st of each year.
- A (BO-9) inspection form must be filed within 14 days of performing inspection (one form per each inspection type for High-Pressure Boilers)
- Defects found during an inspection must be corrected within 90 days via an Affirmation of Correction (BO-13) and must be submitted within 14 days of the date corrections were made.
- Reports submitted more than 180 calendar days from the BO-9 inspection date will incur a late penalty of $50/boiler/ month/inspection.
- Reports submitted more than 12 months after the inspection date will be deemed expired and incur the full penalty of $1,000/ boiler/inspection.
- Note: Owner/licensee may request up to two 45-day extensions for the following inspection filing deadline online for a $15 filing fee (BO-13E).
What’s explicitly required for High-Pressure Boilers?
- Electric high-pressure boilers must be annually inspected as high-pressure boilers (in accordance with Article 303, Title 28 NYC Admin Code).
- Two inspections are required: internal and external.
- These inspections must be conducted within the same cycle (year) but should be performed six months apart.
- Inspections can only be performed by an authorized insurance company.
- Inspectors must notify the DOB at least 10 days before performing the internal inspection via e-mail (hpboilers@buildings.nyc.gov).
- Failure to accomplish these dual inspections can result in an HBLVIO violation
- Failure to file either annual boiler inspection - $1,000 fine
What’s explicitly required for Low-Pressure Boilers?
- Inspections can only be performed by authorized boiler inspectors licensed by the Department of Buildings or an authorized insurance company
- Failure to accomplish these dual inspections can result in an LBLVIO violation

First Test Inspections
Newly installed boilers and boilers that have undergone the replacement of more than half of their principal components/sections or whose fuel burners have been replaced must undergo a First Test Inspection conducted by the DOB before use.
What’s required to remove a Boiler from a building?
- An OP49 form must be filed (online via DOB NOW) with the DOB as confirmation of a boiler removal or disconnection. This form must be submitted within 30 days of removal/disconnection, or it may be subject to late penalties. Filing an OP49 is critical - if you don’t officially remove a boiler with the DOB, they may still issue annual administrative penalties for failure to file annual inspections - even if the building itself is demolished.
